Current and former employees filed a class action lawsuit against the retail store alleging violations of the Employee Retirement Income Security Act (ERISA). Former participants in the Mercantile Stores Pension Plan filed class action complaints alleging improper amendments to the plan violated ERISA and claimed payment calculations were discriminatory on the basis of age.
