Three Cabot Shopping Centers Facing ADA Lawsuits
Unfortunately, we were right.
Three Cabot shopping centers were sued last month by Rickey Stringfellow, who suffers from multiple health conditions and has to use a walker or motorized wheelchair to get around.
Stringfellow's attorney is Edward Zwilling of Birmingham, Ala., who filed four ADA lawsuits against restaurants in Jonesboro in February. Three of the cases are still pending, and one has reached an out-of-court settlement.
Stringfellow has sued J. Green Development Co., Sourthfork Bay Development Group LLC and the Edge Plaza LLC in U.S. District Court. He claims the developments haven't met ADA requirements.
The officials from the shopping centers couldn't be reached.
Stringfellow wants the properties to be ADA compliant and pay his attorney fees.
But, remember, in Arkansas, plaintiffs aren't entitled to damages for ADA access lawsuits.
Still, settling an ADA lawsuit could cost a business anywhere from $10,000 to $100,000 or more, according to the Lawyers Against Lawsuit Abuse APC of San Diego. The price for defending the case at trial could run between $100,000 and $500,000.
