CAW, Ferguson Near Settlement

Have your heard talk of an 11th-hour settlement in the legal fight between Central Arkansas Water and upscale homebuilder Rick Ferguson?

The details were still in negotiations as we went to press Thursday. But the talks seemed headed toward a deal that would result in:

ðÐCAW deciding not to force the sale of 300 acres on the north side of Lake Maumelle through eminent domain.

ðÐFerguson agreeing to divert any runoff from the southern border of his Waterview Estates project away from the lake.

Such a settlement would also affect CAW's stated intention of forcing Deltic Timber Corp. to sell 705 acres on the south side of the lake.

This land was part of The Ridges at Nowlin Creek, an upscale residential development planned by Deltic.

What's behind CAW's change of heart?

We understand the latest million-dollar study of Lake Maumelle commissioned by CAW indicated there are viable alternatives for protecting the water quality of the largest source of drinking water in central Arkansas that don't involve land acquisition.
